1. INFORMATION ABOUT THE HOLDER

These Terms and Conditions govern contracting through the Website, owned by DEMAR IBÉRICA SERVICIOS S.L. (hereinafter, “OLISSEN”), with tax ID C.I.F. B-88493887, and address at Avenida de Fuentemar 20, Nave B21, 28823, Madrid (hereinafter, “OLISSEN”, or the “Website”).

2. ACCEPTANCE OF THE GENERAL CONDITIONS

By accepting these Terms and Conditions, the Consumer User (hereinafter, the “User”) agrees to act at all times in accordance with the provisions established in this legal text.

The User declares that they are over 18 years old and have full capacity to understand and accept the content of these Conditions.

3. OBJECT

This Website has been developed by OLISSEN with the purpose of offering Users the possibility of purchasing the different products offered on the Website, via purchase through the Website.

4. OPERATION OF THE OLISSEN WEBSITE

Browsing the Website and user account
Browsing the Website is free for all Users and does not require registration to access the information. Registration is only necessary when the User wishes to purchase Products via the Website using an account, or to subscribe to the Newsletter.

Users bear full responsibility for their User Account. Accordingly, Users are responsible for properly safeguarding and keeping secret their username and/or password that grant access to their Account, and commit not to transfer their use to third parties, whether temporarily or permanently, nor permit access by third persons.

Accordingly, Users must immediately notify OLISSEN by email (info@olissen.com) of any misuse of their username and/or password, due to theft, loss, or unauthorized access, so that cancellation may be effected without delay.

Purchase or acquisition process
Product information (hereinafter, “Products”) available for purchase is displayed on the Website, and Users can consult the specific conditions, details, and information about each product before proceeding to payment. Once the User has selected products, they may review the order summary in the shopping cart and modify their order as desired.

To proceed with the purchase, the User must provide the following personal data:

  • Full name

  • Shipping address

  • Email and/or mobile phone

  • Banking data for billing

The User is responsible for the accuracy of their data and must communicate any changes to OLISSEN.

Prices and payment methods
Access to Website content is completely free and does not require prior registration. Accordingly, the User only pays for acquiring Products. The purchase prices current at the time the order is placed are those displayed on the Website and will be in Euros (€).

Shipping costs and applicable taxes will be itemized separately in the shopping cart and shown in the order summary before the order is processed. The User is informed that shipping costs vary depending on the delivery address.

OLISSEN offers the following payment methods:

Credit and debit card payments: accepting payments via Visa, Mastercard, Maestro, American Express, UnionPay debit cards, UnionPay credit cards, and enabling card payment gateways such as Apple Pay and Google Pay.

Payments are subject to checks and authorizations by the issuing entities (card issuers or account issuers) independent of OLISSEN. If such an entity does not authorize the payment, the purchase procedure cannot continue, the order will be automatically canceled, and the sale of the requested Product will be considered not finalized.

Delivery periods, place, and loss
Shipping and delivery of Products
We offer free shipping throughout the national territory (Peninsula, Balearic Islands, Canary Islands, Ceuta and Melilla) and to the following countries: Germany, Andorra, Austria, Belgium, France, Italy, Netherlands, and Portugal.

For other EU countries, automatic rates will be applied during checkout. International shipments outside the EU may incur additional customs duties or charges, which will be borne by the customer.

OLISSEN also provides several pick-up points selectable on the Website.

Delivery times for Products are as follows:

  • Spain: between 1 and 3 business days from order confirmation.

  • European Union: between 2 and 5 business days.

Orders are prepared and shipped Monday through Friday, from 9:00 to 17:00. Orders placed outside this schedule are processed the next business day.

If you have created an account when placing your order, you can track the status of your shipment in the “Orders” section of your account. You will receive a tracking link by email and/or SMS once your order has been processed. You may check the shipping status at any time. If you cannot access it, contact OLISSEN at info@olissen.com.

User absence at delivery
If delivery is attempted when the User is not present at the delivery address, OLISSEN informs that up to 3 delivery attempts will be made. If absent, the order will remain available 10 days at the pickup point designated by the courier. If the customer does not collect the Product, a refund will be made minus incurred logistics costs.

Wrong delivery
If the User receives a Product different from the one ordered, the User must initiate the return in accordance with these Terms and Conditions, indicating that it is a wrong delivery. OLISSEN will contact the User as soon as possible to provide next steps and resolve the matter promptly.

Changes to the delivery address
Once the order is in transit, modifications to the delivery address cannot be made, as this would incur additional cost. Users are asked to verify that their delivery data is correct to avoid delivery issues or unnecessary charges.

Have you not received your order?
If the estimated delivery period has passed, we recommend contacting the courier company to check shipment status.

If it appears delivered but you have not received it, please write to: info@olissen.com, providing your order number and full name. We will assist you in resolving it.

Exchanges and Returns
Right of withdrawal
Returns are free within the national territory (Iberian Peninsula, Balearic Islands, Canary Islands, Ceuta, and Melilla), as well as in Germany, Andorra, Austria, Belgium, France, Italy, Netherlands, and Portugal.

For returns from other EU countries not included in the free-returns policy, return shipping costs will be paid by the customer.

The customer has a period of 14 calendar days from receipt of the order to withdraw from the purchase. To exercise this right, they must notify in writing from the same email used in the purchase, sending a message to returns@olissen.com with the order number and pickup address.

To exercise the right of withdrawal, the User must include in the email:
Subject: Return of purchased product
Full name
Contact email
Order number and pickup address
Purchase date
By this notice I request the refund of the amount paid for the above product and that said refund be made within the fourteen (14) day legal period, and be credited to my bank account number: ________
Place and date of the claim: ________________

Once the request is received, we will provide further instructions for correctly returning the product.

Conditions of return
The product must be returned in its original condition, unused, along with original packaging and all accessories and promotional materials included.

Once the returned item’s condition is verified and approved, a full refund will be issued via the same payment method, within 7 to 15 business days. In countries with return shipping costs, the cost will be informed before confirmation and will be deducted from the refund.

Exchanges
OLISSEN does not perform direct physical exchanges. If the customer wants another model, they must return the original product and place a new order on the Website.

Account deactivation
The User may deactivate their registration account at OLISSEN at any time via the Website or by emailing info@olissen.com.

The User may re-register with a new account later with no penalties or restrictions from the Website.

Product warranty
At OLISSEN, we support the quality and durability of our products. Therefore, all our items are covered by a legal warranty of 3 years from the purchase date, applicable for manufacturing defects.

This warranty does not cover:

  • Damage caused by improper use, lack of maintenance or accidents (e.g. breakage of frames, lenses or arms).

  • Wear or aesthetic alterations from normal use, such as loss of shine, scratches, discoloration, deterioration of bridge or frame, or fading of inscriptions on arms.

5. USER CONDUCT

Users commit to using all information or content accessed via the Website lawfully, diligently, honestly and correctly under principles of good faith, respecting applicable law and these Conditions.

In particular, but not limited to, Users shall not:

  • Provide untrue, inaccurate, incomplete or outdated data, nor impersonate another user or any person or identity.

  • Use the Website for fraudulent or illegal purposes.

  • Use the Website or its content in illicit ways, contrary to these Conditions, public order or rights of third parties, or in a way that may damage, disable or overload the Website or prevent normal use.

  • Introduce or intentionally spread viruses or other harmful systems into the Website, OLISSEN’s systems, its providers’ systems, or third parties’ systems.

  • Probe or test vulnerabilities of OLISSEN’s systems or networks or attempt to bypass security or reverse engineer software used to provide the Website services.

  • Remove, hide or manipulate notices about intellectual or industrial property rights or other identifying data of OLISSEN.

  • Use the Website to send or reuse materials containing illegal, offensive, obscene, defamatory, threatening content, or that violate copyright, trademarks, privacy, confidentiality or other rights, or that contain viruses, advertising, SPAM, chain mail or mass mailings.

  • Download, send or distribute content or applications that may violate applicable law or infringe on any rights.

  • Send mass or repetitive messages to many people or share third-party email addresses without consent.

  • Promote or encourage others to engage in such prohibited practices.

The User also assumes responsibility for correct use of the Website, including using it only to make inquiries or search offers.

The User declares to be over 18 and legally capable to understand these Terms and Conditions.

6. INTELLECTUAL PROPERTY

All rights over content, design and source code of the Website — including but not limited to images, photographs, texts, logos, designs, trademarks, trade names, data included on the Website and any other intellectual and industrial property rights — are owned by OLISSEN or by third parties who have expressly authorized OLISSEN their use on the Website.

Thus, under Royal Legislative Decree 1/1996 of April 12 (revising the Intellectual Property Act), Law 17/2001 of December 7 on Trademarks, and related legislation, reproduction, transmission, adaptation, translation, distribution, public communication (including making available), in whole or in part, by any means or in any medium, is expressly prohibited, unless OLISSEN gives prior written authorization.

OLISSEN grants no license or usage rights over its intellectual or industrial property or any related rights, and in no event shall access and navigation by Users be understood as a waiver, transfer, license or assignment, in full or in part, of those rights.

Any unauthorized use of these contents is a serious breach of intellectual or industrial property rights and will incur legally established liabilities.

7. PERSONAL DATA PROTECTION

OLISSEN guarantees the security and confidentiality of personal data that Users provide in compliance with Regulation (EU) 2016/679 (GDPR) and Organic Law 3/2018 on Data Protection and guarantee of digital rights (LOPDGDD).

In this regard, Users are informed that they may exercise the following rights:

  • Access their personal data

  • Request correction of inaccurate data

  • Request deletion of their data

  • Request limitation of data processing

  • Object to data processing

  • Exercise the right to be forgotten

  • Request portability of their data

Users also have the right not to be subject to decisions based solely on automated data processing.

8. LIABILITY AND WARRANTIES

Limitation of liability
Through this clause the User is informed that OLISSEN has implemented sufficient security measures to satisfy legally required standards and the level of diligence expected of a professional. OLISSEN uses its best efforts to prevent faults, interruptions, viruses, or harmful components on the Website.

However, as OLISSEN cannot control all factors possibly causing such events, it cannot guarantee that they will never affect Website navigation. In such cases, OLISSEN commits to act diligently and resolve the problem as soon as it becomes aware of it. The User commits not to provide false data, including fictitious names or emails, not to engage in illegal activity in connection with use of the service, and not to permit anyone else to do so.

Any attempt to exploit the service contrary to these Terms and Conditions may result in termination of service at the Website’s discretion.

Suspension and cancellation of services
OLISSEN may temporarily suspend accessibility to the Website for maintenance, repair, updates or improvements. Whenever circumstances allow, OLISSEN will notify the User in advance of scheduled service suspension.

OLISSEN reserves the right to remove, limit or block access to the Website when technical difficulties arise from circumstances beyond OLISSEN’s control that, in its judgment, reduce or nullify established security standards necessary for proper operation.

OLISSEN is not liable for cancellation or suspension of services on the Website due to causes not attributable to it. In any case, OLISSEN commits to rectify issues and support the User toward a rapid solution of the incident.

9. DURATION AND MODIFICATION

These conditions in force are those published at the time the User accesses the Website.

If any provision here is declared unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the rest remain in full force and effect.

OLISSEN may delete, modify or replace the contents of this document at any time, notifying Users via the Website or by email.

10. COMPLAINTS AND CLAIMS

The User may send complaints, claims or comments to OLISSEN via the contact details provided at the beginning of these Terms and Conditions.

11. JURISDICTION AND APPLICABLE LAW

For resolution of all disputes relating to this website or activities carried out therein, Spanish law shall apply, to which the parties expressly submit.

Likewise, for resolving conflicts arising from or related to its use:

  • Consumers and Users: the courts where the consumer lives or where the obligation is to be performed will have jurisdiction.

  • Business persons and professionals: the courts of the city of Madrid will have jurisdiction.

12. TERMINATION

Under Regulation (EU) No. 524/2013 of May 21 relating to online dispute resolution in consumer matters, OLISSEN informs Users residing in the European Union that in case of dispute they may resort to the “Online Dispute Resolution Website” created by the European Commission to try to resolve any controversy extrajudicially.

13. SEVERABILITY CLAUSE

All clauses or provisions of these Terms of Use must be interpreted independently and autonomously. The invalidity of one clause does not affect the rest of the provisions. The affected clause(s) will be replaced by others that preserve the intended effects of these terms.
